1. About these terms
These terms cover any work you buy from The Fresh Site — websites, branding, advertising management, or any combination of those. By paying for a package (via Stripe or otherwise) or by accepting a written quote from us, you're agreeing to these terms.
If anything's unclear, email hello@thefreshsite.com before you pay — once a project's underway it's harder to unpick.
2. About us
The Fresh Site is a sole-trader web design studio based in Paignton, Devon (TQ3). We're contactable by email at hello@thefreshsite.com.
3. Our services
We currently offer:
- Starter Website — 4-page hand-coded website, delivered in 4 days
- Growth Website — up to 8 pages, delivered in 8 days
- Branding Package — logo, colour palette, font system, brand guidelines
- Website + Branding Bundle — both of the above, delivered together
- Meta Ads Management — monthly ad campaign management on Facebook and Instagram
- Google Ads Management — monthly campaign management on Google
What each package includes is listed on the services page. Anything not listed there isn't included and would be quoted separately.
4. Quotes and prices
Prices shown on the site are inclusive of all design and build work for the package described. For advertising management packages, your ad spend (paid directly to Meta or Google) is additional and separate from our fee.
Founder's Pricing — until 30 June 2026 we're running a launch promotion with reduced prices. After that date, prices return to standard rates. Any quote or payment link issued before that date locks in the Founder's Pricing rate.
5. Payment
Website, branding, and bundle packages are paid in full upfront via Stripe. We don't begin work until the payment has cleared. Stripe accepts most major cards plus Apple Pay, Google Pay, Klarna and Clearpay (split-payment options at no extra cost).
Advertising management packages are billed monthly in advance. Your ad spend with Meta or Google is billed directly by them on whatever schedule they set — we never see or handle your card details for ad spend.
Invoices and receipts for all payments are sent by email within 24 hours of payment clearing.
6. Project timelines
Stated delivery times are working days, counted from when we receive everything we need from you to start. A typical clock starts the morning after payment clears and you've sent through (or signed off on) the project brief.
- Starter Website — 4 working days from kick-off
- Growth Website — 8 working days from kick-off
- Branding Package — 5 working days from kick-off
- Bundle — 8 working days from kick-off
If we miss a delivery date through our own fault, we'll keep working until it's done — no extra charge. If a delay is caused by us waiting on feedback, content, or approvals from you, the clock pauses until we have what we need.
7. Your responsibilities
For us to deliver on time, we need you to:
- Send us a clear brief at the start, or be available for a kick-off call.
- Provide content (copy, photos, logos, brand assets) when we ask for it. If you don't have content, tell us up front and we'll discuss copywriting as part of the project.
- Reply to feedback requests within a reasonable window — typically 48 hours. Extended silences pause the project clock.
- Sign off the final draft within 5 working days of us sending it. After that, we treat it as approved.
- Make sure you have the legal right to use anything you send us (photos, logos, copy from existing sources, etc.). We don't verify rights for you — that's your call.
8. Revisions
Each package includes a fixed number of revision rounds:
- Starter — 1 round of revisions
- Growth — 3 rounds of revisions
- Branding — 2 rounds of revisions
- Bundle — combined from the above
A "round" means one batch of changes — give us everything you want adjusted at once. Additional rounds beyond what's included are billed at a fair hourly rate, agreed up front before any extra work begins.
Wholesale rewrites, new pages, or structural changes after the design has been signed off aren't revisions — they're new scope, and we'll quote those separately.
9. Hosting and aftercare
Every website package includes 12 months of hosting free from the date the site goes live. After that, hosting is £29.99 per month, which covers:
- Hosting, domain renewal admin, and SSL
- Security updates and patches
- Small ongoing tweaks (copy edits, photo swaps, service updates)
- Email support, replied to within 2 working hours
If you choose not to renew, we'll hand over the codebase and help you move host. Bigger changes (new pages, fresh sections, redesigns) aren't covered by the hosting plan and would be quoted separately.
10. Intellectual property
Once a project is paid in full and signed off, you own the final deliverables — the website code, design assets, brand files, everything. Source files (Figma, raw assets) are handed over on request.
We retain the right to feature the work in our portfolio, case studies, and on social media unless you ask us not to in writing.
Until full payment is received, all rights remain with us. Open-source libraries used in the build (e.g. Astro, GSAP) stay under their own licences.
11. Confidentiality
Anything you share with us during a project — business plans, customer data, pricing strategy, draft copy — is treated as confidential. We don't share it externally, sell it, or use it for anything other than delivering your project.
12. Cancellation and refunds
Before work has started
If you change your mind within 14 days of buying a package and we haven't yet started work, you're entitled to a full refund. Just email us.
Once work has started
Bespoke design and code work is, by its nature, custom to your business. Once we've begun (typically the morning after payment), the 14-day cancellation right falls away under the UK Consumer Contracts Regulations 2013 — you'll have expressly agreed to this when you paid. Refunds at that point are at our discretion based on how far through the project we are.
Monthly advertising management
Cancel any time with 30 days' notice. We'll finish out the current billing period and refund any prepaid amount beyond the cancellation date. Ad spend with Meta or Google is non-refundable from us — that's between you and them.
13. Liability
We'll do our best work for you. But we can't guarantee specific commercial outcomes — search rankings, leads generated, ad results, conversion rates, sales. Too many variables are outside our control.
Our total liability under any project is capped at the amount you paid us for that project. We're not liable for indirect, consequential, or business-loss damages. Nothing in these terms limits our liability for death, personal injury, or fraud — those exclusions are always available where the law requires them.
14. Third-party services
Your finished site will rely on third-party services we integrate (hosting provider, Stripe for payments, Google for fonts and analytics where enabled, etc.). We're not responsible for the availability, behaviour, or pricing changes of those third parties — but we'll always tell you up front who they are and how they're used.
15. Force majeure
We're not liable for delays caused by events outside our reasonable control — internet outages, hardware failures, acts of nature, illness, government action, supplier failures. We'll communicate any such delays as soon as we know about them and do our best to get things back on track.
16. Changes to these terms
We may update these terms occasionally — for example, when launching a new service or changing a process. The version in force at the time you purchased applies to your project. Changes apply only to new projects from the date of update.
17. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you're a consumer outside the UK, you keep any mandatory rights under your local law.
